The Promotion is only open to residents of Canada who are eligible to participate according to the rules described in Section 2.
No purchase is necessary to participate in the Frankie’s Merry Cluckmas Mystery Gift Promotion (“the Promotion”). See Section 3.B for information on how to participate without making a purchase.
The physical location of Frankie’s Fried Chicken at 3025 Comox Rd, Courtenay, British Columbia will hereafter be referred to as the “Restaurant”.
Any person eligible to participate in this Promotion will be referred to as a “Participant”. A “Gift” may be a food or non-food item. A single Gift with the greatest monetary value will be referred to as the “Grand Gift”. The term “Gift Token” refers to a folded sheet of paper describing the Gift the Participant will receive. A “Gift Envelope” is a sealed envelope containing the Gift Token.
Participants will be able to participate in the Promotion for a limited time, referred to as the “Promotion Period”, described in Section 1. The Promotion Period schedule has two phases. The first phase is the time period during which Gift Envelopes are distributed (the “Distributing Phase”). The second phase is the time period during which the Gift Envelopes may be opened and the Gifts given (the “Gifting Phase”). The dates of these phases are given in Section 1.
1. Description of the Promotion
With each purchase of $10 or more made at the Restaurant (excluding delivery orders) during the Distributing Phase, any customer who meets the eligibility requirements in 2.B may receive one (1) Gift Envelope and become a Participant. The total supply of Gift Envelopes shall be rationed daily such that Gift Envelopes are available for distribution in each day of the Distribution Phase. Gift Envelopes shall be given at random. Qualifying customers may request a gift envelope with their order.
The general rules of the Promotion are:
The Participant shall not open the Gift Envelope
The Participant must return to the Restaurant with the sealed Gift Envelope during the Gifting Phase
The Participant must open the Gift Envelope in view of a staff member at the Restaurant
The Participant receives their Gift
These rules, in common English, are printed clearly in large type on each Gift Envelope.
The Promotional Period begins on December 10, 2020 and ends on January 31, 2021.
The Distributing Phase begins on December 10, 2020 and runs to December 31, 2020, or until the supply of Gift Envelopes is exhausted, whichever comes first.
The Gifting Phase begins on January 1, 2021 and runs to January 31, 2021, during the publicly posted hours of business at the Restaurant.
A. Barring the exceptions to eligibility in 2.B, the Promotion is open only to residents of Canada. There is no age limit to participate.
B. The following are not eligible to participate in the Promotion:
Any person who, on or after December, 2020, was or is an owner, manager, employee, or agent of Frankie’s Fried Chicken.
Any person involved in producing the Gift Tokens or Gift Envelopes.
Any direct family members of the persons described in (a) or (b), including spouse, sibling, step-sibling, parent, step-parent, child, step-child, or any person who resides in the same home.
3. How to Receive a Gift Envelope
A. Make an in-person purchase of $10 or more at the Restaurant. Orders for pick-up, paid online or in-person, are eligible. Orders for delivery are not eligible.
B. Request a Gift Envelope by mail. To request a Gift Envelope, send the request by mail in a postage-paid envelope containing the request and a self-addressed return envelope with sufficient postage affixed. Only one request per mailing will be honoured. Only one request per return mailing address will be honoured. Only requests postmarked with a date within the Distributing Phase will be honoured. Mail requests that are received after the supply of Gift Envelopes is exhausted cannot be honored. Mail requests to Frankie’s Fried Chicken, 3025 Comox Rd, Courtenay BC, V9N 3P7.
4. How to Receive a Gift
A. During the Gifting Phase of the Promotion, Participants may bring their Gift Envelope to the Restaurant to open in the presence of a Frankie’s Fried Chicken employee (an “Employee”).
B. The Participant must give the Employee the Gift Token so it can be marked as redeemed and removed from circulation.
C. The Gift described on the Gift Token must be rendered immediately (with the exception of the Grand Gift). The Participant may not return at a later time or date, within the period of the Gifting Phase or after, to receive the Gift.
D. The Grand Gift is not physically located at the Restaurant to keep it secure. The Employee and the Participant can arrange the delivery or pick-up of the Grand Gift.
D. Opening a Gift Envelope in any location other than the Restaurant will immediately invalidate the Gift Token inside. The Gift Token will not be honoured.
E. Opening a Gift Envelope without the oversight and/or participation of an Employee will immediately invalidate the Gift Token inside. The Gift Token will not be honoured.
F. Participants are not allowed to give their sealed Gift Envelope to any other person.
G. Participants may open multiple Gift Envelopes during a single visit to the Restaurant, and receive all the Gifts indicated by the Gift Tokens at one time.
5. Gift Distribution
There are a total of 500 Gifts to distribute:
i) One (1) $500 Grand Gift. Odds of winning are 1 in 500.
ii) Four (4) $25 Frankie’s Fried Chicken gift cards. Odds of winning are 1 in 125.
iii) Ten (10) Frankie’s Travel Mugs, with an approximate value of $20.00. Odds of winning are 1 in 50.
iv) Twenty (20) Frankie’s Sandwich Meals, approximate value $9.89. Odds of winning are 1 in 25.
v) Twenty (20) Dozen Donut Bites, approximate value $4.99. Odds of winning are 1 in 25.
vi) Eighty (80) Half-Dozen Donut Bites, approximate value $2.99. Odds of winning are 1 in 6.25.
vii) Sixty (60) Large Coleslaw, approximate value $3.49. Odds of winning are 1 in 8.3.
viii) One hundred (100) Large Fries, approximate value $3.99. Odds of winning are 1 in 5.
ix) Two hundred and five (205) Small Fries, approximate value $1.99. Odds of winning are 1 in 2.44.
6. Disclaimer of Warranties
UNLESS SPECIFIED IN THIS AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.
By participating in the Promotion and by receiving a Gift, each Participant (or the legal guardian on behalf of each minor Participant) agrees and grants the right but not the obligation to use their voice, likeness, and statements in any and all media, including Internet, in perpetuity and throughout the universe, for advertising and promotional purposes, without notice, review, approval, or compensation.
A. Disqualification: Each Participant is responsible for complying with the rules of the Promotion. Frankie’s Fried Chicken reserves the right at our sole discretion to disqualify any person who tampers with Promotion materials, violates the rules of the Promotion, or interferes with the operation of the Promotion.
B. Force Majeure: Frankie’s Fried Chicken reserves the right at any time and for any reason, without prior notice, to terminate the Promotion, in whole or in part, or to modify the rules as needed, subject to any governmental approval.
C. Errors: Frankie’s Fried Chicken will remedy printing or production errors with replacement of the defective materials while supplies are available. Replacement is the sole remedy for printing and production errors.
D. Invalidity: Any rules of this Promotion which may be determined by competent authority to be prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such rule in any other jurisdiction. In such case, the parties shall in good faith modify or substitute such rule(s) consistent with the original intent of the parties.
E. Governing Law: This Promotion shall be governed by and construed in accordance with the laws of British Columbia and the laws of Canada applicable therein. Any and all disputes arising under these rules, whether as to interpretation, performance or otherwise, shall be subject to the exclusive jurisdiction of the courts of the Province of British Columbia and each of the parties hereto hereby irrevocably attorns to the jurisdiction of the courts of such province.
